Issues

Plaintiffs in these personal injury and wrongful death lawsuits are alleging that asbestos contaminated the talc that was used in various talcum powder products, which caused them or a deceased loved one to develop mesothelioma.

Essentially, the plaintiffs in these asbestos-talc mesothelioma lawsuits have claimed that the companies responsible for the these talcum powder products knew of the asbestos contamination but chose to sell their products anyway, putting profits over safety.

On the other side, defendants tend to argue that either (1) their products were not contaminated with asbestos, or (2) if the products were contaminated, then the user could not have been exposed to enough asbestos to cause mesothelioma.  Lastly, when asbestos fibers are found in tissue samples taken from the person diagnosed with mesothelioma, then the companies’ final line of defense is that the asbestos must have come from some other source — and, of course, not from their talcum powder products.
